Another claim against Nicholson business developer

At least one more business claims it is owed money by the company that built the new Dollar General store in Nicholson.

Kelly Feduchak, whose husband Tim is a masonry contractor, said he and his partner haven't been paid by LGN Management for work they did last winter.

"They owe them over $37,000," Feduchak said.

LGN, of South Williamsport, was the general contractor that put up the building on State Street. The building was finished in late May, and Dollar General opened its retail business in it shortly after.

Feduchak said her husband and partner Kevin Benedict of Glenwood did much of the concrete block work to construct the building starting in November.

LGN wanted them to pour the concrete for the floor in January, but Tim Feduchak declined to do the work until he got paid, his wife said. She said LGN then got another subcontractor to do the work.

Feduchak said her husband and his partner plan to take legal action against LGN. Because of the amount, the matter can't be handled by a magisterial district justice. They have turned the matter over to their attorney, Michael Giangreco of Montrose, to determine what the next course of action will be.

Feduchak emphasized that the complaint is against LGN and not Dollar General. However, she admitted that LGN's actions reflect on the retail operator as well.

"I wrote letters to the executives of Dollar General. It's putting a bad name on them," Feduchak said.

Last week, two businesses filed civil complaints against LGN with Magisterial District Justice Russell Shurtleff, claiming nonpayment for work done.

Nicholson Lumber Company and owner Bruce Herron are seeking a judgment for $7,595.32 as the past due balance on merchandise purchased,.

And Keller Crushing and Screening, along with owner Craig Keller, of Tunkhannock, has a claim for $7,420.60 for an unpaid stone bill.
